Why we collect it

We collect information about you so that we can personalise your use of the site, assist your use of the site and improve the site generally. Depending upon your selections for our data protection questions we may arrange for you to be sent information about related products and services from us and carefully selected third parties (see Who we disclose it to section). You may update the answers to your questions at any time.

Who we disclose it to

  1. We will only pass on information about you as an individual (as opposed to aggregate information) to third parties to enable us to perform services requested by you or with your prior consent.
  2. If you give your consent, we will pass your contact details to third parties who may then occasionally send communications to you to provide information, offers and services that may be of interest to you.
  3. In certain circumstances, we may need to disclose information about you if you breach this privacy policy or if you breach the Terms and Conditions. We may also disclose or access your account if required to do so by law or by any Governmental body.
  4. We will only pass on information about you as an individual (as opposed to aggregate information) to third parties overseas to enable us to perform services requested by you.

When will we process your personal information

In terms of the Protection of Personal Information Act (POPIA), the justification ground which we base our processing on consist out of the following:

  • The data subject or a competent person where the data subject is a child consents to the processing. Kindly note that you have the right to withdraw your consent;
  • The processing is necessary to carry out actions for the conclusion or performance of a contract to which the data subject is a party;
  • The processing complies with an obligation imposed by law on the business;
  • The processing protects a legitimate interest of the data subject;
  • The processing is necessary for the proper performance of a public law duty by the business;

The processing is necessary for pursuing the legitimate interests of the business or of a third party to whom the information is supplied.

Your data protection rights

  • You are entitled to access your personal data by sending a written request to leon@mtrack.co.za. We may charge you a fee for this service as set out in terms of Condition 8 of POPIA.  
  • You may also request Mtrack South Africa to correct or supplement any of your personal data which Mtrack South Africa will undertake as soon as practicable.
  • Request the destruction of your personal data. leon@mtrack.co.za will consider your request in light of any other laws or regulations prohibiting Mtrack South Africa from destroying your personal data.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.

Security

Keeping information about you secure is very important to us and certain sections of the site may encrypt data using SSL or a comparable standard. However, no data transmission over the Internet can be guaranteed to be totally secure.
